Terms of Use

These Terms of Use ("Terms") govern your access to and use of the FITT16™ platform ("FITT16", "the Service"), operated by PLAYNICELY PTY LTD, a company registered in South Africa ("we", "us", "our"). By accessing or using FITT16, you agree to these Terms.

Payments for the Service are processed by Stripe and billed by our payments entity, PLAYNICELY MARKETING FZCO (Dubai, United Arab Emirates); see Section 8.

1. WHAT FITT16 PROVIDES

FITT16 converts your CliftonStrengths® Full 34 results into an interpretive personality framework ("Archetype") and provides access to AI-powered tools personalised to your results.

You can:

• Create an account
• Upload your CliftonStrengths® Full 34 PDF
• Receive an instant personalised dashboard
• Access an AI-generated interpretation and personalised report
• Download your report
• Interact with an AI companion (the Navigator) for self-directed reflection personalised to your Archetype
• Use Career Calibration, a guided process that helps you work out your next career move
• Use Connections to exchange results with another registered user and see a private read of the dynamic between you (see Section 5)
• Add people to your network using the "People in My Life" feature

FITT16 provides interpretation and reflective navigation only. It is not a clinical, psychological, or therapeutic service. No outputs from FITT16 should be relied upon as professional advice of any kind.

2. NO AFFILIATION WITH GALLUP OR OTHER PROVIDERS

FITT16 is an independent product. It is not affiliated with, endorsed by, or sponsored by Gallup, Anthropic, or any other third-party provider whose tools or services are referenced or used within the platform.

You may only upload CliftonStrengths® reports that you personally own.

3. AI-GENERATED CONTENT

FITT16 uses Anthropic's Claude AI to generate interpretive outputs, reports, navigation responses, career-calibration guidance, and Connection reads. All AI-generated content is provided for informational and self-development purposes only, and represents reflective prompts for you to consider rather than statements of fact about you.

You acknowledge that:

• AI outputs may not always be accurate or complete
• AI responses are not a substitute for professional advice
• We are not responsible for decisions you make based on AI-generated content

Your conversation and content data is not used to train any AI model. See our Privacy Policy for full details on how AI data is handled.

4. ACCEPTABLE USE

You may not use FITT16 to generate, solicit, store, or distribute content that is unlawful, offensive, sexually explicit, harmful, or that violates the rights of any third party.

The AI tools are strictly intended for personality interpretation, career reflection, relationship insight, and strengths-based self-development. Use of FITT16 to generate content outside of this purpose — including abusive, deceptive, or harmful content — is prohibited and may result in immediate account termination.

5. CONNECTIONS AND SHARING BETWEEN USERS

The Connections feature lets you and another registered user agree to exchange results so the Service can generate a private read of the dynamic between you.

Mutual consent is required. A connection is created only when one person invites another and the other accepts. By sending an invitation, you confirm you are entitled to contact that person. By accepting an invitation, you agree to exchange your archetype and talent-theme data with the inviter for the purpose of the read, as described in the Privacy Policy.

What is shared. Once connected, each person can see the other's name and FITT16 archetype. Underlying talent themes are used only in the background to generate the read and are not displayed to the other person.

Your responsibilities. You must only invite people you genuinely know and have a legitimate reason to connect with. You must not use Connections to harass, impersonate, or send unwanted invitations, or to attempt to obtain another person's data without their genuine consent. You must not use another person's results, notes, or the AI read of your dynamic for any purpose that would harm, profile, or disadvantage them.

Revocation. Either person may remove the connection at any time, which deletes the exchanged snapshots and associated read as described in the Privacy Policy.

6. USER RESPONSIBILITIES

You agree to:

• Provide accurate information when creating your account
• Use FITT16 for lawful purposes only
• Not reverse-engineer, copy, scrape, or redistribute any content or outputs from the platform
• Only upload CliftonStrengths® reports that belong to you
• Use the Connections feature only as permitted in Section 5

You retain ownership of your personal data. You grant us permission to process it solely to deliver the Service as described in our Privacy Policy.

7. INTELLECTUAL PROPERTY

All FITT16 content, including archetypes, descriptions, type names, frameworks, software logic, data models, scoring methodology, and reports, is the exclusive intellectual property of PLAYNICELY PTY LTD (South Africa).

Users may not:

• Copy, republish, or reproduce FITT16 content
• Sell or resell FITT16 outputs
• Use FITT16 content to build derivative tools, frameworks, or competing products

You may share your own personal report freely.

8. PAYMENTS AND BILLING

FITT16 is offered as a paid product, including your personalised report and access to the platform's AI features, at the price displayed at checkout.

In addition, you may make optional purchases within the Service, including purchasing one or more connection "seats" — access that you may sponsor on behalf of another person so they can join and connect with you. Where a purchase is quantity-based, the quantity and total are shown before you pay.

Payment is processed securely via Stripe and billed by PLAYNICELY MARKETING FZCO (Dubai, United Arab Emirates). By completing a purchase, you authorise the charge at the amount shown. Pricing is displayed in full before purchase. We do not store your payment card details.

Sponsored seats. Purchasing a seat for another person entitles that person to create an account and accept your invitation. It does not give you any access to, or control over, their data. A sponsored person who does not register or accept does not entitle you to any additional service or refund beyond what applicable law requires.

Refund Policy. FITT16 is a delivered digital product. Once a purchase is completed and access is granted, no refunds will be issued except where expressly required by applicable law.

9. ACCOUNT DELETION

You may delete your account at any time via Account Settings → Danger Zone → Delete my account.

Deletion permanently removes your profile, CliftonStrengths data, Navigator and Companion history, Career Calibration content, Connection snapshots and reads, AI-generated outputs, and all associated personal data within 72 hours. Financial transaction records are retained as required by applicable law.

Deleting your account does not entitle you to a refund of any fees paid.

10. TERMINATION BY US

We may suspend or terminate accounts that:

• Violate these Terms or the Acceptable Use Policy
• Attempt to abuse or misuse the AI tools
• Misuse the Connections feature, including sending unwanted or deceptive invitations
• Engage in unauthorised sharing or extraction of intellectual property

Termination does not entitle you to a refund of any fees paid.

11. LIMITATION OF LIABILITY

FITT16 is not responsible for decisions you make based on interpretations, AI navigation responses, career-calibration guidance, or Connection reads, or for outcomes in your professional, personal, or relational life.

To the maximum extent permitted by applicable law, we exclude liability for indirect or consequential loss, loss of income, business or opportunities, and psychological, emotional, or interpersonal outcomes.

This Service is provided "as is" without warranties of any kind.

12. GOVERNING LAW

These Terms are governed by the laws of the Republic of South Africa. Any disputes arising from these Terms shall be subject to the jurisdiction of the South African courts.

Users in other jurisdictions may also have rights under their local laws, including data-protection and consumer-protection legislation, which these Terms do not exclude.

13. CHANGES TO THESE TERMS

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. Continued use of the Service after changes constitutes acceptance of the updated Terms.
