Terms of Service

These Terms of Service (“Terms”) govern your use of the FITT16 platform (“FITT16”, “the Service”), operated by PLAYNICELY MARKETING FZCO, Building A1, Dubai Digital Park, Dubai Silicon Oasis, Dubai, United Arab Emirates (“we”, “us”, “our”).

By accessing or using FITT16, you agree to these Terms.

1. What FITT16 Provides

FITT16 converts your CliftonStrengths® results into an interpretive personality framework (“Archetype”).
‍
You can:

  • Create an account
  • Upload your Full 34 CliftonStrengths® PDF
  • Receive an instant dashboard
  • Access an AI-generated interpretation
  • Download a personalised report
  • Email reports to others
  • Use additional coaching tools

You agree that FITT16 provides interpretation, not assessment, and is not a clinical or psychological diagnostic tool.

2. No Affiliation with Gallup or MBTI

FITT16 is an independent interpretive tool.
‍
It is:

  • Not affiliated with Gallup
  • Not affiliated with CliftonStrengths®
  • Not affiliated with MBTI or CPP

You may only upload reports that you personally own.

3. User Responsibilities

You agree to:

  • Provide accurate information
  • Use FITT16 for lawful purposes
  • Not reverse-engineer, copy, or redistribute content

You retain ownership of your data, but grant us permission to process it solely to deliver the Service.

4. Intellectual Property

All FITT16 content — including archetypes, descriptions, names, frameworks, software logic, data models, and reports — is the exclusive IP of PLAYNICELY MARKETING FZCO.
‍

Users may not:

  • Copy, republish, or reproduce content
  • Sell or resell FITT16 outputs
  • Use FITT16 content to create derivative tools or frameworks

You may share your own report freely.

5. Payments, Invoicing, and Third-Party Terms

5.1 Merchant of Record and Payment Processing

a. All purchases of products and services (“Services”) through this website that are invoiced or billed are processed by Paddle, acting as the Merchant of Record for transactions pursuant to invoiced consumer arrangements.
b. By purchasing Services or accepting an invoice from Paddle, you agree that Paddle is responsible for payment acceptance, billing, collections, taxes, and related functions. Paddle’s details and legal terms are available at:

5.2 Binding Paddle Terms

a. Your purchase of any Services processed by Paddle is governed by Paddle’s Invoiced Consumer Terms and Conditions (“Paddle’s Terms”).
b. By completing a transaction or accepting an invoice, you agree to be bound by Paddle’s Terms as a part of your agreement for those purchases.

5.3 Priority of Terms

To the extent there is any conflict between these Terms of Use and Paddle’s Terms with respect to billing, payment, invoicing, taxes, refunds, cancellations, or charge disputes, Paddle’s Terms control for those matters.

5.4 Authorization to Share Information

You authorize us to share your purchase-related information with Paddle to facilitate invoicing and payment processing. Paddle’s use of your data for those purposes is governed by Paddle’s privacy terms referenced in Paddle’s Terms.

5.5 Refunds and Billing Disputes

All refund requests, billing disputes, and payment issues are handled in accordance with Paddle’s Terms. If you have a query regarding a charge, invoice, or refund, please follow the dispute resolution process set out in Paddle’s Terms

6. Limitation of Liability

FITT16 is not responsible for:

  • Decisions you make based on interpretations
  • Outcomes in your professional, personal, or relational life
  • Inaccurate data you provide

To the maximum extent permitted by law, we exclude liability for:

  • Indirect or consequential loss
  • Loss of income, business, or opportunities
  • Psychological, emotional, or interpersonal outcomes

This service is provided “as is” without warranties of any kind.

7. Account Deletion

You may delete your account at any time by contacting hello@fitt16.com.
Deletion removes:
‍

  • Your user profile
  • Stored PDF
  • Extracted talent data
  • Dashboard data
  • AI-generated outputs

‍

8. Termination

We may suspend or terminate accounts that:

  • Violate these Terms
  • Attempt to abuse the system
  • Engage in unauthorised sharing or extraction of IP

9. Governing Law

These Terms are governed by the laws of Free Zone, Dubai, United Arab Emirates.
