Terms of Service

These Terms of Service ("Terms") govern your use of the FITT16 platform ("FITT16", "the Service"), operated by PlayNicely PTY Ltd, 3 Hugon Rd, Claremont, Cape Town, South Africa ("we", "us", "our"). By accessing or using FITT16, you agree to these Terms.

1. What FITT16 Provides

FITT16 converts your CliftonStrengths® results into an interpretive personality framework ("Archetype") and provides access to an AI-powered chat coach based on your results.

FITT16 provides interpretation and conversational support, not assessment, coaching, psychological advice, or any clinical or therapeutic service. You agree that FITT16 provides interpretation and is not a clinical or psychological diagnostic tool. No outputs from FITT16 should be relied upon as professional advice.

2. No Affiliation with Gallup or MBTI

FITT16 is an independent product. It is not affiliated with Gallup, CliftonStrengths®, MBTI, or CPP.

FITT16's AI chat coach is powered by third-party AI models (including OpenAI's GPT). FITT16 is an independent service and is not affiliated with, endorsed by, or sponsored by OpenAI or any other AI model provider. You may only upload CliftonStrengths® reports that you personally own.

3. AI-Generated Content

FITT16 uses third-party AI models to generate interpretive outputs, reports, and chat responses. All AI-generated content is provided for informational and self-development purposes only.

You acknowledge that:

  • AI outputs may not always be accurate or complete
  • AI responses are not a substitute for professional advice
  • We are not responsible for decisions you make based on AI-generated content

4. Acceptable Use Policy

You may not use FITT16 to generate, solicit, store, or distribute content that is unlawful, offensive, sexually explicit, harmful, or that violates the rights of any third party. The AI chat coach is strictly intended for personality interpretation and strengths-based self-development. Use of FITT16 to generate any content outside of this purpose — including NSFW, abusive, or deceptive content — is prohibited and may result in immediate account termination.

5. User Responsibilities

You agree to:

  • Provide accurate information
  • Use FITT16 for lawful purposes
  • Not reverse-engineer, copy, or redistribute content

You retain ownership of your data, but grant us permission to process it solely to deliver the Service.

4. Intellectual Property

All FITT16 content — including archetypes, descriptions, names, frameworks, software logic, data models, and reports — is the exclusive IP of PLAYNICELY PTY LTD.

Users may not:

  • Copy, republish, or reproduce content
  • Sell or resell FITT16 outputs
  • Use FITT16 content to create derivative tools or frameworks

You may share your own report freely.

5. Payments, Invoicing, and Third-Party Terms

7. Payments and Billing

FITT16 is currently offered as a single bundled purchase, including the personalised report and access to the AI chat coach, at the price displayed at checkout.

Payment is processed securely via Stripe. By completing a purchase, you authorise the charge at the amount shown. Pricing is displayed in full before purchase.

Refund Policy

‍FITT16 is a delivered digital product. Upon purchase and access being granted, no refunds will be issued except where expressly required by applicable law, including the South African Consumer Protection Act.

6. Limitation of Liability

FITT16 is not responsible for:

  • Decisions you make based on interpretations or AI chat responses
  • Outcomes in your professional, personal, or relational life
  • Inaccurate data you provide

To the maximum extent permitted by law, we exclude liability for:

‍

  • Indirect or consequential loss
  • Loss of income, business, or opportunities
  • Psychological, emotional, or interpersonal outcomes

This service is provided "as is" without warranties of any kind.

7. Account Deletion

You may delete your account at any time by contacting howcanwehelpyou@fitt16.com. Deletion removes your user profile, stored PDF, extracted talent data, dashboard data, and AI-generated outputs. Deleting your account also cancels any active subscription. No refund will be issued for any remaining subscription period upon deletion.

8. Termination

We may suspend or terminate accounts that:

  • Violate these Terms or the Acceptable Use Policy
  • Attempt to abuse or misuse the AI chat system
  • Engage in unauthorised sharing or extraction of intellectual property

Termination does not entitle you to a refund of any fees paid.

9. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes arising from these Terms shall be subject to the jurisdiction of the South African courts.
